Breaking! Missouri to allow people to vote to drop out of Obamacare

The Missouri Legislature has passed legislation to allow Missouri’s voters to decide if Missouri will opt out of Obamacare. This makes Missouri the first state to do so.

The Aug. 3 ballot issue will ask voters to decide whether to amend state statutes to “deny the government authority to penalize citizens for refusing to purchase private health insurance.”STLToday.com

The referendum vote will be scheduled for August, 2010. This is good news for me. I have a decision coming up on how I’m to provide healthcare to myself and my wife when my employer-provided healthcare ends in October. I’m retiring at the end of October and I REALLY didn’t want to have whatever remains of Medicare to be my only option.

Missouri House Republicans had pushed the vote as a protest of the federal mandate to purchase insurance that is part of the legislation passed by Congress earlier this year. Democrats argued that the August vote will be meaningless because federal law generally trumps state law.

But during debate Tuesday, lawmakers agreed that at least one byproduct of the vote would be that it would likely spur a lawsuit challenging the federal legislation.

“This will set up a constitutional showdown,” said state Rep. Tim Jones, R-Eureka.

Jones had sponsored the original version of the bill, which would have asked Missouri voters to amend the state’s constitution to basically opt out of the federal mandate. But the Senate changed the bill to make the August vote merely a statutory change.

Lt. Gov. Peter Kinder, a Republican, has threatened to file a lawsuit on behalf of the state to challenge the federal health care legislation. Kinder is raising money in a private corporation to fund such a lawsuit.—STLToday.com

I understand the feds cannot let this action stand unopposed. There are a number of states that are working towards the same goal, Oklahoma, Florida and Arizona at this time. I expect more states will join the march to end this federal tyranny.

  1. Good to hear that, just wish my state did this. But as Old NFO point out, this is going to get interesting as it approaches the Supreme Court.
