Well…it’s a start. What am I talking about? A US Appeals Court is limited the Patriot Act. Specifically, limiting the NSA authority to collect telephone data without a warrant. No more mass collection.

Top federal court rules against NSA’s phone records program

A federal court has decided that the National Security Agency’s (NSA) bulk, warrantless collection of millions of Americans’ phone records is illegal.

The sweeping decision from the Second Circuit Court of Appeals on Thursday represents a major court victory for opponents of the NSA, and comes just as Congress begins a fight over whether to renew the underlying law used to justify the program.  

That program “exceeds the scope of what Congress has authorized,” Judge Gerard Lynch wrote on behalf of the three-judge panel.

The law “cannot be interpreted in a way that defies any meaningful limit,” he added.

The key section of the Patriot Act that ‘allows’ the government to collection information has been interpreted too broadly according to the bill’s author, Rep, Jim Sensenbrenner (R-Wis.). It is §215 that is flawed and the section that the 2nd Appellate Court is limiting.

But, the win in court may be moot. Despite efforts by the White House, the NSA and statists in Congress, §215 is due to expire within a month.

It is increasingly difficult for those who identify on the left and right to find anything they agree upon, but this morning CNN anchor and law school graduate Chris Cuomo provided those across the political spectrum with some common ground.

Cuomo was hosting a Twitter conversation about the constitutionality of hate speech and wrote:

Morning Twitter Update, 5.6.15: Chris Cuomo is getting the fighting words doctrine and First Amendment hilariously wrong.

Chris Cuomo phonically learned the dit-dit of law but has no basic understanding of law and rights. That’s why all the dumb.

That word, “chaplinsky,” refers to Chaplinsky v. New Hampshire, in which the Supreme Court decided that some speech — like “fighting words,” or other statements that incite violence — aren’t protected by the First Amendment. Unfortunately for Cuomo:

I love how Cuomo screams READ THE CONSTITUTION then cites case law (incorrectly).

Also, of course, @ChrisCuomo completely overlooks the face-to-face requirement as he alleges that fighting words doctrine somehow applies.

As a followup to Cuomo’s use of, “Chaplinski,” it has largely been reversed. You can follow the link above to see how limited it was. The limitation with ‘Chaplinski’ is that it requires a face-to-face confrontation. None of those requirements are met contrary to Cuomo’s assertions.
Not even über-liberal Salon can stomach Cuomo’s idiotcy.

Criminal goverment

That is a shocking title for a post, but it is accurate. We have governments, federal, state, and local, that commit criminal acts…and get away with it. Some years ago, our county commission approved contracts where some commissioners had a monetary interest and would profit. One commissioner resigned and another lost his re-election bid.

At the state level, we have the commander of the State Highway Patrol illegally send personal information on all Missouri CCW holders to the federal government, not once, but twice. In addition, the DMV, or whatever name it is, collected personal data from CCW and driver license renewals and new applicants and sent that information to an outside organization, again, in violation of state law.

Then there are the feds. For them, the list seems to be endless from shipping guns to the drug cartels in Mexico, to refusing to enforce numerous federal laws, to arbitrarily changing federal law without authorization. I call it thugocracy.

But I guess, nothing reaches the level of one of our elected officials advising the public to commit manslaughter at best or murder at worst.

Joe Biden gets a Detroit woman killed.

Good job there, Mr. Vice President:

It was shortly before 1 a.m. Nov. 2 and Renisha McBride was involved in an accident with a parked vehicle in Detroit.

More than two hours later and six blocks away, she was shot in the face by a man who told police he thought someone was breaking into his Dearborn Heights home. The 54-year-old homeowner, according to police, said his 12-gauge shotgun discharged accidentally.

…and by “good job” I mean “I hope that you’re happy, Joe Biden.” Because that homeowner did what Joe Biden told people to do (bolding mine):

V.P. BIDEN: Well, the way in which we measure it is—I think most scholars would say—is that as long as you have a weapon sufficient to be able to provide your self-defense. I did one of these town-hall meetings on the Internet and one guy said, “Well, what happens when the end days come? What happens when there’s the earthquake? I live in California, and I have to protect myself.”

I said, “Well, you know, my shotgun will do better for you than your AR-15, because you want to keep someone away from your house, just fire the shotgun through the door.”

And he told them that more than once:

In a Facebook town hall hosted by Parents magazine, vice president Joe Biden responded to a woman concerned that bans on various weapons may make law-abiding citizens more susceptible to criminals with the following advice: “If you want to protect yourself, get a double-barreled shotgun.” “You don’t need an AR-15, it’s harder to aim, it’s harder to use,” he stressed.

Biden indicated that he has given his own wife the same advice. “I said, ‘Jill, if there’s ever a problem, just walk out on the balcony here, put that double-barreled shotgun and fire two blasts outside the house,’” he said, and urged viewers, in closing, “Buy a shotgun, buy a shotgun!”

This is what a Democrat politician thinks is a ‘pro gun’ message, by the way: shake the Magic Boom Stick in the air and fire the Devil Bees in random directions until the Bad Man flees into the night. Out in the real world, what actually happens when you try that is that you run an unacceptably high risk of having a woman take a load of buckshot to the face.

Look, guns are not toys* and they are not magic staffs. They are very dangerous tools, designed to do a very specific job. If you do not treat them with respect and caution, you run the risk of misusing it, and thus causing a tragedy. If this is too difficult, it’s best to not have a gun in the first place. But even if you do not have a gun, it is still in everybody’s best interest if people speak responsibly about firearms. That includes the people that do not like firearms.

So you do not COWBOY it, Mister Vice President. This is not the WILD WEST or a VIDEO GAME. This is the UNITED STATES OF AMERICA and IN the USA there are people who think that surely the government would not let the Vice President say stupid things that would get people KILLED. Until they figure out that we really are letting Joe Biden do that, I suggest that Joe Biden stop talking.

If there are two politicians that I have less use for than John McCain and Ron Paul, I can’t think of them at the moment.  Well, OK, Lindsey Graham is close. John McCain and Ron Paul finally said something that I can “like.”

John McCain was speaking to some reporters about the Benghazi investigation when a reporter attempted to divert the conversation to Patreaus’ resignation. McCain, as he has before on occasion, let his temper flare.

Wednesday seems to be a testy day for press conferences.

John McCain smacked down a reporter following his remarks on the Benghazi investigation.

In response to a question about whether classified documents found leaked in the Gen. Petraeus scandal posed a greater national security threat than the Benghazi attack, McCain quickly responded, “Well I say with great respect, that’s one of the dumbest questions I’ve ever heard.”

He continued, “There’s 4 dead Americans. There’s 4 dead Americans. Not a socialite.” The reporter attempted to interrupt but McCain quickly stopped him. “I’m answering your question. Ok, do you want me to answer your question or do you want to interrupt? Which do you want?”

After a short pause he continued, “There’s 4 dead Americans. The lives of other Americans were put in jeopardy. This is a matter of 4 dead Americans. I think that the other issue raised is very serious and I think it deserves a thorough and complete investigation. But it does not rise to the level of an attack on an American consulate that took four American lives.”

 The reporter failed in his attempt to divert attention to Obama’s failures and mismanagement of the Benghazi attack. McCain rightly slapped him down.

The second occurance was during Ron Paul’s farewell speech to the US House…a speech long overdue. Be that as it may, Ron Paul finally said something that agrees with my views—the coming extinction of the MSM.

Ron Paul: Internet is the alternative to ‘government media complex’ that controls the news

During part one of his farewell speech to Congress, Rep. Ron Paul insisted that the internet remain free, as it is an important alternative to the “government media complex.”

“The internet will provide the alternative to the government media complex that controls the news and most political propaganda,” Paul stated. “This is why it’s essential that the Internet remains free of government regulation.”

The media is not our friend. At best it is a some-what useful tool to be understood and used when appropriate. Unfortunately, the MSM does have a captured audience who are oblivious of alternate news and information outlets. If we are to be able to present our views and arguments over the MSM propaganda outlet, we must find a means to infiltrate into those areas of the internet where that “captured” MSM audience can be found…Facebook, YouTube, twitter and other social sites. The trick is to find a method when you cannot force your audience to join you or read your posts. We need a means to attract that audience to us.

Frankly, I don’t know how to do that. But if we are to reclaim our government, end the runaway spending and taxation, we’ll have to find a means to attract more of the nation’s population to us and to join us. Waiting for the collapse of the economy and government is NOT a viable plan.
